Volunteer Release

Important: This document is a release of certain claims. Read it carefully before signing. In consideration of Catamount Racing permitting me to volunteer or participate in Team activities, I agree as follows. This Agreement applies to my volunteer service in any capacity, including serving as a ride leader, sweep, coach, mentor, event helper, or administrative or logistical volunteer. Covered activities include mountain biking, training rides, skills clinics, races, rider supervision and support, event setup and cleanup, travel associated with Team activities, use of Team equipment, and related volunteer duties (collectively, the Activities). Acknowledgment and assumption of risks. I understand that the Activities involve inherent and other risks, known and unknown, including falls; collisions with riders, vehicles, fixed objects, wildlife, or obstacles; uneven or changing terrain; rocks, roots, drops, jumps, and trail hazards; weather and temperature; physical exertion; lifting or moving equipment; equipment failure; negligent acts or omissions of other participants; remote locations; and delayed access to emergency care. These risks may result in property damage, serious injury, permanent disability, paralysis, or death. Serving as a ride leader or otherwise assisting riders may involve responding to accidents, helping injured participants, and navigating unpredictable situations. I voluntarily participate and assume these risks to the fullest extent permitted by law. Volunteer responsibilities. I will follow applicable laws, Team policies, safety procedures, and directions from Team management. I will undertake only duties appropriate to my abilities, experience, training, and authorization, and promptly communicate any limitations or safety concerns. When riding, I will wear a properly fitted bicycle helmet and use equipment in safe working condition. I understand that this Agreement does not replace any required screening, training, certification, or approval for my volunteer role. Release of ordinary-negligence claims. To the fullest extent permitted by California law, I release and discharge Catamount Racing and its current and former directors, officers, employees, coaches, volunteers, agents, sponsors, affiliated entities, and owners or operators of land or facilities made available for Team activities (collectively, the Released Parties) from claims, demands, causes of action, damages, or liabilities arising from or related to my participation in the Activities or performance of volunteer duties, including claims based on the ordinary negligence of a Released Party. Limits of release. This release does not apply to claims that cannot lawfully be released, including claims based on a Released Party's gross negligence, recklessness, willful injury, fraud, or other conduct for which release is prohibited by law. Indemnity. To the fullest extent permitted by law, I will indemnify and hold harmless the Released Parties from third-party claims, damages, and reasonable costs to the extent caused by my negligent acts or omissions, willful misconduct, or breach of this Agreement in connection with the Activities. This obligation does not apply to the extent a claim is caused by a Released Party's own negligence or other wrongful conduct, or to any liability that cannot lawfully be indemnified. Emergency medical care. If I am unable to provide consent, I authorize Catamount Racing representatives to seek emergency medical assistance and transportation on my behalf. I understand that care will be provided as permitted by law and accept responsibility for resulting medical and transportation expenses to the extent those expenses are my legal responsibility. Personal property. I am responsible for my bicycle, equipment, vehicle, and other personal property used or brought to the Activities. To the fullest extent permitted by law, the Released Parties are not responsible for loss of or damage to my personal property, including loss or damage caused by their ordinary negligence. This provision does not apply to conduct for which liability cannot lawfully be released. Severability and governing law. This Agreement is governed by California law. If any provision is unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law. By signing, I confirm that I am at least 18 years old, have carefully read and understand this Agreement, understand that it includes a release of ordinary-negligence claims, and sign it voluntarily.
